A judicial law clerk for the U.S. Court of Appeals for the Fifth Circuit makes the case, in the Tennessee Journal of Law & Policy, that “federal oversight is a poor regulatory mechanism for a variety of balanced incentives and extensive interest group influence.” Decentralized regulation, on a state by state basis, is far more promising. The author looks for lessons to the period of (federal) prohibition of alcohol.
